APTEL Litigation

We regularly appear before the Appellate Tribunal for Electricity on tariff disputes and regulatory matters. We recently secured interim relief in a high-value tariff dispute, obtaining status quo of 50% of a tariff adjustment on a retrospective basis for our client.

Corporate Disputes & NCLT

Our corporate disputes practice covers insolvency, restructuring and company-law disputes before the NCLT and NCLAT — including securing reliefs such as injunctions and regulatory oversight, negotiated settlements and buyout arrangements, disputes stemming from breach of joint venture or investment agreements, and disputes relating to valuation, earn-out clauses and indemnity obligations. We recently represented a Corporate Debtor in a Section 7 petition where the NCLT rejected the applicant's claim against our client, with costs.

Alternative Dispute Resolution

Commercial Disputes & Pre-Institution Mediation

Commercial disputes typically arise out of business transactions and relationships — including breach of contract, non-payment or delayed payment, shareholder disagreements, joint venture conflicts, franchising and distribution issues, construction/project failures, specific performance, and enforcement of foreign arbitral awards or judgments.

The Commercial Courts Act, 2015 (as amended in 2018) established specialised commercial courts at the district and High Court level, accelerating resolution of disputes above a "specified value" — currently INR 3 lakh or more. Section 12A of the Act requires parties to any commercial suit (except those seeking urgent interim relief) to undertake pre-institution mediation before filing suit; non-compliance results in automatic rejection of the plaint under Order VII Rule 11 of the CPC. Where parties reach settlement, it carries the effect of an arbitral award under Section 30 of the Arbitration and Conciliation Act, 1996 — binding and enforceable as a court decree.
